SMS Terms

These SMS Terms describe the text-messaging programs operated by 9byNine, LLC, doing business as 9xNine ("9xNine," "we," "us," or "our"). By opting in to receive text messages from us, you agree to these terms. Our handling of your information is described in our Privacy Policy.

Program Description

We operate two messaging programs, each with its own consent:

• Account and inquiry messages: texts related to your inquiry or engagement with us — such as scheduling, appointment confirmations, reminders, follow-ups to questions you've asked, and service updates.
• Marketing messages: texts about our services, offers, and content — sent only if you separately and expressly consent to receive them.

Consent to one program is not consent to the other, and consent to receive text messages is not a condition of any purchase.

How You Opt In

You opt in by providing your mobile number and checking the applicable consent box on one of our forms or surveys, by texting us a keyword we publish, or by otherwise giving us your express written consent. We keep a record of your consent.

Message Frequency

Message frequency varies based on your inquiry and interaction with us. We aim to keep messaging useful and infrequent.

Message and Data Rates

Message and data rates may apply to messages we send and messages you send us, according to your mobile plan. Contact your wireless provider with questions about your plan.

How You Opt Out

Reply STOP to any message at any time to opt out. You will receive a single confirmation message, and no further messages will be sent to you in that program unless you opt in again. You can also opt out by emailing [email protected] with the mobile number you'd like removed. Opting out of marketing messages does not stop account and inquiry messages you have separately consented to, and vice versa.

Your Number and Your Privacy

Mobile phone numbers and SMS opt-in consent are never shared with, or sold to, third parties or affiliates for their marketing or promotional purposes. We share this information only with service providers acting on our behalf (such as our SMS delivery platform) as needed to send you the messages you have requested. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your wireless provider and network availability.

Eligibility and Your Responsibilities

You must be at least 18 years old and the account holder (or have the account holder's permission) for the mobile number you provide. You agree to notify us promptly if you change or deactivate your mobile number, so we don't message a number that no longer belongs to you.

Changes to These Terms

We may update these SMS Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes to the programs will be communicated as required by law.
