Privacy Policy

Last updated: July 10, 2026

This Privacy Policy explains how 9byNine, LLC, doing business as 9xNine ("9xNine," "we," "us," or "our"), collects, uses, and shares information when you visit our website, use the client portals we operate, complete our forms or surveys, book a discovery call, or otherwise communicate with us. Our services are designed for businesses located in the United States. By using our site or services, you agree to the practices described here.

Information We Collect

Information you provide

When you fill out a form or survey, book a call, or contact us, we may collect your name, business name, email address, phone number, website, and any details you choose to share about your business and marketing needs.

Information collected automatically

When you visit our website, we may automatically collect certain technical information, such as your IP address, browser type, device information, pages viewed, and how you interact with the site. We collect this through cookies and similar technologies, described in the "Cookies and Tracking Technologies" section below.

Analytics and advertising

We use, or may use, cookies and similar technologies for analytics and advertising, including tools such as Google Analytics and the Meta (Facebook) Pixel. These help us understand site usage and measure the performance of our marketing. You can control cookies through your browser settings, and you can opt out of certain advertising technologies through the providers' own tools. You can learn more about how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites.

How We Use Your Information

  • To provide, operate, and improve our services and website.
  • To respond to your inquiries, schedule and prepare for discovery calls, and provide customer support.
  • To send you transactional messages (such as scheduling, confirmations, and reminders) and, where you have consented, marketing communications.
  • To understand how our site and campaigns perform and to improve them.
  • To protect our rights, prevent fraud or abuse, and comply with legal obligations.

Text Messaging (SMS)

If you provide your phone number and give consent, we may send you text messages related to your inquiry — such as scheduling, confirmations, and reminders — and, where you separately consent, marketing and promotional messages. Message frequency varies. Message and data rates may apply. You can reply STOP at any time to opt out, or HELP for help. Consent to receive text messages is not a condition of any purchase. Mobile phone numbers and SMS opt-in consent are never shared with, or sold to, third parties or affiliates for their marketing or promotional purposes. We share this information only with service providers acting on our behalf (such as our SMS delivery platform) as needed to send you the messages you have requested. Full program details are available in our SMS Terms.

Cookies and Tracking Technologies

Cookies are small text files placed on your device when you visit a site. We use cookies and similar technologies (such as pixels and local storage) in the following categories:

  • Essential cookies: required to operate the site, keep it secure, and deliver core functions such as forms, surveys, and booking. These cannot be switched off through our site.
  • Preference cookies: remember choices you make, such as form progress, so you don't have to re-enter information.
  • Analytics cookies: help us understand how visitors use the site — which pages are viewed, how long visits last, and where visitors come from — using tools such as Google Analytics. This information is aggregated and used to improve the site.
  • Advertising cookies: used by tools such as the Meta (Facebook) Pixel and Google advertising services to measure campaign performance and, where applicable, show you relevant ads on other platforms.

Cookies may be "session" cookies (deleted when you close your browser) or "persistent" cookies (which remain until they expire or you delete them).

Managing cookies

You can set your browser to refuse some or all cookies or to alert you when cookies are being sent; however, some parts of the site may not function properly without them. You can also opt out of specific tools directly: install the Google Analytics opt-out browser add-on, or use the industry opt-out pages at optout.aboutads.info and networkadvertising.org/choices to opt out of interest-based advertising from participating companies. We do not currently respond to browser "Do Not Track" signals.

How We Share Information

We do not sell your personal information. We may share information in the following limited circumstances:

  • Service providers: vendors that help us run our business — such as our CRM and marketing platform, email and SMS delivery providers, scheduling tools, and analytics and advertising providers — who process information on our behalf.
  • Legal and safety: when required by law, or to protect the rights, property, or safety of 9xNine, our clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

Data Retention

We keep personal information for as long as needed to provide our services, communicate with you, and fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. You may request deletion of your information as described below.

Your Choices and Rights

  • Marketing opt-out: you can unsubscribe from marketing emails using the link in any message, or reply STOP to opt out of marketing texts.
  • Cookies: you can manage cookies as described in the "Cookies and Tracking Technologies" section above.
  • Access and deletion: you may request to access, correct, or delete the personal information we hold about you by emailing us at [email protected].
  • California residents: if you are a California resident, you may have the right to request access to or deletion of your personal information and to opt out of the "sale" or "sharing" of it. We do not sell your personal information. To make a request, contact us at the email above.

Data Security

We use reasonable administrative, technical, and organizational measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Children's Privacy

Our website and services are intended for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.

Third-Party Links

Our site may link to third-party websites or services that we do not control. This policy does not apply to those third parties, and we encourage you to review their privacy policies.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our site or services after changes take effect means you accept the updated policy.
